Payroll update – Holiday pay ruling

Yesterday, an Employment Appeal Tribunal ruled that non-guaranteed overtime must be taken into account for the purposes of calculating holiday pay.  This ruling will be a concern to employers and although there may be an appeal to the decision, businesses should consider how the findings will affect the way in which they are currently calculating holiday pay.  The tribunal did however alleviate some concerns by placing limits on any retrospective claims employees could make.
